Subsidy Layering Review (SLR) Request Portal Requirements

Overview 

The Georgia Department of Community Affairs (DCA) conducts Subsidy Layering Reviews (SLRs) for Georgia Housing Tax Credit developments that include Project-Based Vouchers (PBVs) when required by the U.S. Department of Housing and Urban Development (HUD). 

An SLR is a multi-step financial review designed to ensure that developments do not receive more public subsidy than necessary. This process is governed by HUD’s 2023 Administrative Guidelines and PIH Notice 2023-15. 

DCA has been authorized by HUD to perform these reviews on HUD’s behalf.  Currently, DCA will only perform subsidy layering reviews for projects that have received low-income tax credits from the Georgia Department of Community Affairs.  

When an SLR is Required 

An SLR must be conducted when: 

  • A PBV project receives additional governmental assistance (federal, state, or local), and  
  • The project is not currently under an executed PBV Housing Assistance Payments (HAP) contract  

When an SLR is NOT Required 

An SLR is not required when: 

  • PBVs are the only source of public assistance, or  
  • The project is already under an active PBV HAP contract (including recapitalization scenarios)  

Submission Requirements 

To initiate an SLR, applicants must submit the following: 

Required Documentation 

  • Complete and updated DCA Core Application with proposed HAP contract rents 
  • Note: The DCA Project Number must be included on all correspondence  
  • Public Housing Authority (PHA) request letter for SLR  
  • Draft PBV HAP Contract or Agreement to Enter into a Housing Assistance Payments Contract (AHAP), if applicable  
  • Rent reasonableness documentation  
  • Environmental review status documentation  
  • Evidence of compliance with PBV program caps and requirements  
  • Source documentation for all funding:  
  • Commitment letters  
  • Soft cost breakdowns  
  • Contingency details  
  • Developer fee disclosure, including payment structure  

Submission Fee 

  • Fee Amount: $3,000  
  • Payable To: Georgia Housing Finance Authority (GHFA)
